SCORE A TRIP TO THE MASTERCARD®* MEMORIAL CUP®† (“Contest”)

NO PURCHASE NECESSARY.  SEE ELIGIBILITY SECTION BELOW FOR FURTHER DETAILS. TO COMPLETE YOUR ENTRY YOU MUST READ AND AGREE TO THE FOLLOWING CONTEST RULES (THE “CONTEST RULES”).  PARTICIPATION IN THIS CONTEST CONSTITUTES FULL AND UNCONDITIONAL AGREEMENT AND ACCEPTANCE OF THESE CONTEST RULES.

ELIGIBILITY: This Contest is only open to residents of Canada who are of the age of majority or older in their province or territory of residence at the time of entry.  Entrants cannot be an employee (or domiciled with an employee, whether related or not) of the Bank of Montreal®, the Canadian Hockey League®†(collectively, Bank of Montreal and the Canadian Hockey League are referred to herein as the “Contest Sponsors”), Promotion Solutions and each of their respective subsidiaries, affiliates, and their respective advertising and promotional agencies (collectively, the “Contest Parties”).

HOW TO ENTER: No purchase necessary.  The Contest begins at 12:00:01 a.m. (Toronto time) on December 1, 2011 and ends at 11:59:59 p.m. (Toronto time) on March 30, 2012 (the “Contest Period”).  There are three (3) ways to enter:

Method No. 1 (For BMO® MasterCard®* Holders): Anytime during the Contest Period, visit www.BMOscoreatrip.com, and register to participate in the Contest by following the Contest link, and fully completing and submitting the online registration form.  The registration form requires you to enter your full name, complete mailing address, valid email address, day and evening telephone numbers, age and the last four digits of your BMO MasterCard. Individuals who register using their BMO MasterCard must have a personal BMO MasterCard; small business MasterCard and corporate MasterCard cannot be used to enter the Contest. Once registered, registrants will automatically receive one (1) entry into the Contest every time they make an eligible purchase using the registered BMO MasterCard during the Contest Period; BMO MasterCard cash advances and ABM withdrawals are not eligible purchases. To be eligible, Contest Sponsors must receive the registration forms and entries during the Contest Period. The Contest server machines are the sole determinant for purposes of determining the timeliness of a valid registration form and entries. If you are not a BMO MasterCard Holder, you may apply by enrolling online at www.bmo.com/personal or by applying in person by visiting any Bank of Montreal branch or BMO MasterCard kiosk.

Method No. 2 (For BMO Debit Card Holders): Anytime during the Contest Period, visit www.BMOscoreatrip.com, and register to participate in the Contest by following the Contest link, and fully completing and submitting the online registration form.  The registration form will require that you enter your full name, complete mailing address, valid email address, day and evening telephone numbers, age and the last four digits of your BMO Debit Card.  Note that your BMO Debit Card must be in respect of a BMO Personal Bank Account. "BMO Personal Bank Account" means a BMO Bank of Montreal personal chequing or savings account – examples: Primary Chequing Account, Interest Chequing Account, or Premium Rate Savings Account. Once registered, registrants will automatically receive one (1) entry into the Contest every time they make an eligible purchase using the registered BMO Debit Card during the Contest Period; ABM withdrawals are not eligible purchases.  To be eligible, the Contest Sponsors must receive the registration form and entries during the Contest Period. The Contest server machines are the sole determinant for purposes of determining the timeliness of a valid registration form and entries. If you are not a BMO Personal Bank Account Holder, you may apply by enrolling online at www.bmo.com/personal.

Method No. 3: Legibly hand print your full name, complete mailing address, valid email address (optional), day and evening telephone numbers, and age on a plain piece of paper and mail it, in a separate, sealed envelope bearing sufficient postage to: Score a trip to the MasterCard Memorial Cup Contest, Dept #2013, PO Box 9500, Oakville, Ontario, L6J 0B6.  Limit of one (1) mail-in entry per outer postage stamped envelope.  Entrants using Method No. 3 will receive one (1) entry into the Contest every time they mail-in an entry in accordance with Method No. 3. The Contest Sponsors will not accept mechanically reproduced, photocopied or bulk entries; all such entries will be void.  Entries submitted by Method No. 3 must be postmarked during the Contest Period and received no later than April 8, 2012.

Contestants can register for the Contest and enter the Contest using Method Nos. 1, 2 and/or 3.

If the winning entry is in respect of an eligible purchase using the registered BMO MasterCard, then the Grand Prize (as defined below) will only be awarded to the person whose contact information matches the contact information set out in the Method No. 1 registration form.  If the winning entry is in respect of an eligible purchase using the registered BMO Debit Card, then the Grand Prize will only be awarded to the person whose contact information matches the contact information set out in the Method No. 2 registration form.  If the winning entry is in respect of a mail-in entry (i.e., an entry using Method No. 3), then the Grand Prize will only be awarded to the person whose contact information matches the contact information set out in that mail-in entry.

GRAND PRIZE: There is one (1) Grand Prize (defined below) available to be won.  The Grand Prize winner (once declared a winner in accordance with these Contest Rules) will receive a trip for four (4) people to Montreal or Quebec City, Quebec, to attend the 2012 MasterCard Memorial Cup in Shawinigan, Quebec, from May 25 to May 27, 2012.  The Grand Prize consists of:

The approximate retail value of the Grand Prize is $3,400.00 CDN based on round-trip ground transportation from the winner’s residence 300 kilometres away from Montreal or Quebec City, Quebec (although the actual retail value may vary depending on the point of departure).

The approximate retail value of the Grand Prize is $9,900.00 CDN based on economy commercial round-trip air transportation from Vancouver, British Columbia to Montreal or Quebec City, Quebec (although the actual retail value may vary depending on the point of departure). 

The winner can invite three (3) guests to participate in the Grand Prize with him or her (the “Guests”).   The winner and his or her Guests must have valid travel documents prior to ticketing and be legally able to travel to Montreal or Quebec City, Quebec.  Further, the winner and his or her Guests must travel on the same itinerary and be available to travel between May 25, 2012 and May 27, 2012.  If the winner and his or her Guests cannot satisfy any of the foregoing conditions then the Contest Sponsors, in their sole and absolute discretion, can disqualify the winner and, if they so choose, select a new eligible winner from all remaining eligible entries.

All departure taxes (at the time of booking), transfers, insurance, items of personal nature and all other costs and expenses not specifically stated as included herein are the sole responsibility of the winner and his or her Guests.  The winner may be required to present a valid major credit card in winner’s name at the time of hotel check-in to cover any incidental expenses.

Flights are not eligible for collection of any loyalty points; no frequent flyer miles will be available.

Travel is subject to the terms and conditions set forth in these Contest Rules, and those set forth by the Contest Sponsor’s airline carrier of choice as detailed in the passenger ticket contract.  Entrants must make all travel arrangements through the Contest Sponsors or their designated agents.

Due to the nature of the Grand Prize, no alternative dates are available other than those selected by the Contest Sponsors. In the event that the winner does not use any portion of the Grand Prize, there will be no extension, transfer, substitution or any kind of compensation provided except at the Contest Sponsor’s sole discretion. The Grand Prize must be accepted as awarded without substitution and is not transferable, is not for resale, and has no cash surrender value. The Contest Sponsors reserve the right, for any reason, to substitute another prize or component of a prize of equal or greater value, without liability. All event tickets are at the discretion of the Contest Sponsors and are subject to change.

The Contest Sponsors are not responsible if the 2012 MasterCard Memorial Cup, or any component thereof, is delayed, postponed or cancelled for any reason and winner will not be reimbursed for tickets.

WINNER SELECTION: The winner will be selected in a random draw from all eligible entries received in accordance with these Contest Rules, on April 30, 2012, at approximately 3:00 pm (ET), in Oakville, Ontario. Odds of being selected depend on the number of eligible entries received.

The selected winner will be contacted within three (3) days of April 30, 2012, by telephone at the telephone number provided by the entrant at the time of entry. At such time, the selected entrant will be required to correctly answer, unaided, a time-limited mathematical skill-testing question to be administered by the Contest Sponsors and confirm his/her eligibility.

The winner and his or her Guests (or his/her parent/legal guardian if the Guest is a minor) will be required to sign the Contest Sponsors’ standard form of Declaration, Release and Waiver (the “Release”) and return same  within the time period specified on the Release. If the Guests do not return the Release within the time period specified therein, then the Contest Sponsors, in their sole and absolute discretion, can disqualify the winner and, if they so choose, select a new eligible winner from all remaining eligible entries.

If the selected winner does not meet all of the Contest conditions, fails to answer the skill-testing question correctly, does not sign and return the properly executed Release within forty eight (48) hours of being contacted by the Contest Sponsors or contact cannot be made within twenty four (24) hours of Contest Sponsors’ first attempt at contact, that entry can, in the sole and absolute discretion of the Contest Sponsors, be disqualified and Contest Sponsors shall be entitled to select a new eligible winner from all remaining eligible entries. The Contest Sponsors are not responsible, whether as a result of human error or otherwise, for any failure to contact any potential winner. Once declared the winner, the selected entrant will be directed as to how to claim his/her Grand Prize.

GENERAL:

  1. By registering for, and/or entering, the Contest, registrants and entrants agree to be bound by the decisions of the Contest Sponsors, which are final and binding without right of appeal with respect to all matters relating to the Contest.

  2. All registration forms and entries will become the property of the Contest Sponsors and will not be returned and proof of submission of a registration form or entry will not be proof of receipt.

  3. Registration forms or entries that are illegible, incomplete or fraudulent are invalid.

  4. By registering for, and/or entering the Contest, registrants and entrants agree to hold harmless the Contest Parties and each of their respective officers, directors, agents, representatives, successors and assigns (collectively, the “Released Parties”), against any and all liability, damages or causes of action (however named or described) with respect to or arising out of: (i) registrant’s or entrant's participation in the Contest, (ii) the receipt or use/misuse of the Grand Prize (or any component thereof) awarded therein; and (iii) the administration of the Contest and distribution of the Grand Prize.

  5. Before being awarded the Grand Prize, the potential winner, and his or her Guests, must sign the Release, releasing the Released Parties from any and all liability arising from, among other things: (i) participation in the Contest; and (ii) acceptance of the Grand Prize (or any component thereof) awarded therein; and (iii) the administration of the Contest and distribution of the prizes awarded therein.  The Release will also grant to the Released Parties the right to the use of his or her name, address (city and province/territory), likeness and photograph without further notice or compensation in any publicity or for promotional purposes carried out by or on behalf of the Released Parties.

  6. By registering for, and/or entering the Contest, the declared winner grants to the Contest Sponsors the right to the use of his or her name, address (city and province/territory), likeness and photograph without further notice or compensation in any publicity or for promotional purposes carried out by or on behalf of the Contest Sponsors.

  7. The Released Parties will not be responsible for late, lost, illegible, misdirected, incomplete, destroyed registration forms or entries or for entries bearing insufficient postage. All such registration forms and/or entries will be void.  

  8. The Released Parties will not be responsible for any event that may cause the Contest to cease either temporarily or permanently, including, but not limited to, any website issue, electronic network, computer problem or any other technical or human error of any kind that makes continuation of the Contest not feasible.  The Released Parties are not responsible for any technical malfunctions of telephone networks or lines, computer on-line systems, servers or access providers, computer equipment, software, viruses, bugs or failure of any entry to be received for any reason including but not limited to traffic congestion on the internet.  Further, the Released Parties will not be liable for any injury or damage to a registrant’s or entrant’s or any other person’s computer related to or resulting from participating or downloading any material in the contest.

  9. The Contest Sponsors reserve the right, in their sole discretion subject only to the approval of the Régie des alcools, des courses et des jeux (the Régie) in Quebec, to withdraw or amend this Contest (or to amend these Contest Rules) in any way, in the event of an error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the reasonable control of the Contest Sponsors that interferes with the proper conduct of this Contest as contemplated by these Contest Rules.  Any attempt to deliberately undermine the legitimate operation of this Contest is a violation of criminal and civil laws and should such an attempt be made, the Contest Sponsors reserve the right to seek remedies and damages to the fullest extent permitted by law.

  10. The Contest Sponsors, with the consent of the Régie, reserves the right to cancel or suspend this Contest, or to amend these Contest Rules without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind.

  11. The Contest Sponsors reserve the right, in their sole discretion, to disqualify any person and void any entries and/or registration forms of that person who it believes has tampered with the entry or registration process or any other component of the Contest, whose conduct or action affects the administration, security or fairness, integrity or proper conduct of the Contest, or who fails to meet or abide by these Contest Rules.

  12. No correspondence will be entered into except with the selected entrant. 

  13. This Contest is subject to all applicable federal, provincial and municipal laws.

  14. All entries and registration forms are subject to verification.  The Contest Sponsors reserve the right, in their sole discretion, to require proof of identity and/or eligibility (in a form acceptable to the Contest Sponsors) to participate in this Contest.  Failure to provide such proof in a timely manner may result in disqualification. 

  15. FOR QUÉBEC RESIDENTS ONLY: Any litigation respecting the conduct or organization of a publicity Contest in Québec may be submitted to the Régie for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement. Fees under Quebec law have been paid.

  16. Your personal information is collected by BMO only for the purposes of administering the Contest and where you have provided consent, to market to you by email on behalf of BMO. For information on BMO’s privacy policy please log on to www.bmo.com/privacy.

  17. In the event of any discrepancy or inconsistency between the terms and conditions of these Contest Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to: the Contest entry form, and/or point of sale, television, print or online advertising; the terms and conditions of these Contest Rules shall prevail, govern and control.
