Great House Hunter Contest

  1. CONTEST PERIOD:

    The Great House Hunter Contest (the "Contest") begins on September 1, 2011 at 12:00:01 a.m. Eastern Time ("ET") and ends on October 9, 2011 at 11:59:59 p.m. ET (the "Contest Period").

  2. ELIGIBILITY:

    Contest entry is open to all legal residents of Canada (excluding Quebec) who (at the time of entry): (i) have reached the age of majority in their province/territory of residence; and (ii) have an AIR MILES®* Collector Card (the "Card"); except employees, representatives or agents (and those with whom such persons are domiciled, whether related or not) of Bank of Montreal (the "Sponsor"), AIR MILES International Trading B.V. or LoyaltyOne, Inc., or their respective parent companies, subsidiaries, affiliates, prize suppliers and advertising/promotion agencies (collectively, the "Contest Parties"). By participating in this Contest, you agree to be legally bound by the terms and conditions of these Official Rules and Regulations (the "Rules").

    IMPORTANT NOTE: The AIR MILES Collector Card can be obtained, free of charge, by visiting www.airmiles.ca. By enrolling to become an AIR MILES collector you agree to be bound by the terms and conditions of the AIR MILES Reward Program as amended from time to time, which are available by contacting 1-888-AIR-MILES or visiting www.airmiles.ca

  3. HOW TO ENTER:

    NO PURCHASE NECESSARY. To enter, send an email (the "Email") during the Contest Period to House.Hunter@bmo.com that contains: (i) your first name, last name, complete mailing address (including postal code) and Card number; (ii) a story (the "Story") that discusses your "house hunting" experience (the "Theme"); and (iii) if applicable, one (1) optional photograph (the "Photo") to accompany your Story (collectively, the "Entry"). To be eligible, your Entry must be received within the Contest Period and your Story (and Photo, if applicable) must be in accordance with the specific Submission Requirements listed below in Rule 4.

    There is a limit of one (1) Entry per person/email address permitted during the Contest Period. For greater certainty, you can only use one (1) email address/Card to enter the Contest. If it is discovered that any person has attempted to: (i) obtain more than one (1) Entry per person/email address during the Contest Period; and/or (ii) use (or attempt to use) multiple names, identities and/or more than one (1) email address and/or Card to enter the Contest; then (in the sole and absolute discretion of the Sponsor) he/she may be disqualified from the Contest. Your Entry will be rejected if (in the sole and absolute discretion of the Sponsor): (i) the Email is not submitted and received in accordance with these Rules during the Contest Period; (ii) your Story (and/or optional Photo, if applicable) is not in accordance with the specific Submission Requirements listed below in Rule 4; and/or (iii) your Story does not reflect the Theme (as determined by Sponsor in its sole and absolute discretion). Use (or attempted use) of multiple names, identities, email addresses and/or any automated or other system to enter or otherwise disrupt this Contest is prohibited and is grounds for disqualification by the Sponsor. The Releasees (defined below) are not responsible for late, lost, misdirected, delayed, incomplete or incompatible Entries.

    All Entries are subject to verification at any time. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification) to participate in this Contest. Failure to provide such proof to the satisfaction of the Sponsor in a timely manner may result in disqualification. The sole determinant of the time for the purposes of a valid Entry in this Contest will be the Contest server machine(s).

  4. SUBMISSION REQUIREMENTS:

    BY SUBMITTING AN ENTRY, YOU AGREE THAT THE ENTRY (AND EACH INDIVIDUAL COMPONENT THEREOF) COMPLIES WITH ALL CONDITIONS STATED IN THESE RULES. THE RELEASEES (DEFINED BELOW) WILL BEAR NO LEGAL LIABILITY REGARDING THE USE OF YOUR ENTRY (OR A COMPONENT THEREOF). THE RELEASEES (DEFINED BELOW) SHALL BE HELD HARMLESS BY YOU IN THE EVENT IT IS SUBSEQUENTLY DISCOVERED THAT YOU HAVE DEPARTED FROM OR NOT FULLY COMPLIED WITH ANY OF THESE RULES.

    Your submitted Entry (and each component thereof) must never have been previously selected as a winner in any other contest. To be eligible for entry in this Contest, your Entry (and each component thereof) must meet the following specific requirements:

    By participating in the Contest, each entrant agrees to be bound by these Rules and by the interpretation of these Rules by the Sponsor, and further warrants and represents that his/her Entry (and each component thereof):

    1. is original to him/her and that the entrant has all necessary rights (including, without limitation, consent of the photographer, as applicable) in and to the Entry (and each component thereof) to enter the Contest;
    2. does not violate any law;
    3. does not contain any reference to or likeness of any identifiable third parties, unless consent has been obtained from each such individual (and his/her parent/legal guardian if he/she is under the age of majority) in his/her jurisdiction of residence (note: if you cannot obtain the consent of an individual appearing in your Photo, as applicable, then his/her face must be blurred out so as to be unrecognizable);
    4. will not give rise to any claims of infringement, invasion of privacy or publicity, or infringe on any rights and/or interests of any third party, or give rise to any claims whatsoever; and
    5. is not defamatory, trade libelous, pornographic or obscene, and further that it will not contain, depict, include, discuss or involve, without limitation, any of the following: nudity; alcohol/drug consumption or smoking; explicit or graphic sexual activity, or sexual innuendo; crude, vulgar or offensive language and/or symbols; derogatory characterizations of any ethnic, racial, sexual, religious or other groups (including, without limitation, any competitors of Sponsor); content that endorses, condones and/or discusses any illegal, inappropriate or risky behaviour or conduct; personal information of individuals, including, without limitation, names, telephone numbers and addresses (physical or electronic); commercial messages, comparisons or solicitations for products or services other than products of Sponsor; any identifiable third party products, trade-marks, brands and/or logos, other than those of Sponsor (e.g. any clothing worn and/or products appearing in your Photo, as applicable, must not contain any visible logos, trade-marks or other third party materials unless the appropriate consents have been obtained --- note: all identifiable third party products, trade-marks, brands and/or logos for which consent has not been obtained by the entrant must be blurred out so as to be unrecognizable); conduct or other activities in violation of these Rules; and/or any other content that is or could be considered inappropriate, unsuitable or offensive, all as determined by the Sponsor in its sole and absolute discretion.

    The Sponsor and/or its promotional agency or designated content moderator (the "Reviewer") will initially screen every Entry. Any Entry that the Reviewer deems, in its sole and absolute discretion, to violate the terms and conditions set forth in these Rules will be disqualified. By entering the Contest and submitting an Entry, each entrant: (i) grants to the Sponsor, in perpetuity, a non-exclusive license to publish, display, reproduce, modify, edit or otherwise use his/her Entry (and each component thereof), in whole or in part, for advertising or promoting the Contest or for any other reason; (ii) waives all moral rights in and to his/her Entry (and each component thereof) in favour of the Sponsor; and (iii) agrees to release and hold harmless the Contest Parties and each of their respective agents, employees, directors, successors, and assigns (collectively, the "Releasees") from and against any and all claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trade-mark infringement or any other intellectual property related cause of action that relate in any way to the Entry (and/or a component thereof).

  5. THE PRIZES AND APPROXIMATE RETAIL VALUES:

    Finalist Prizes: There will be eight (8) Finalist Prizes available (one (1) per Finalist, defined below), each consisting of one thousand and five hundred (1,500) AIR MILES reward miles (the "Finalist Prize(s)"). Approximate retail value of the Finalist Prize varies by travel service and date selected - example: from Montreal to New York return air travel for one passenger for October departure is 1,250 reward miles, which is approximately $408.00 CDN.

    Grand Prize: There will be one (1) Grand Prize available consisting of ten thousand (10,000) AIR MILES reward miles (the "Grand Prize"). Approximate retail value of the Grand Prize varies by travel service and date selected - example: from Toronto to Beijing, China return air travel for one passenger for October departure is 9,300 reward miles, which is approximately $1244.00 CDN. The approximate retail value of AIR MILESĀ® reward miles prize depends on the chosen method of redemption and available reward options at the time of redemption. If redeemed for flights (950 reward mile minimum required for flight redemption), value depends on destination chosen, date of travel and use of multiple carriers or suppliers. For example, one return economy flight from Toronto, Ontario to Winnipeg, Manitoba is 1750 AIR MILES reward miles and has an approximate value of $525.00 (Canadian) excluding taxes. Winner must pay applicable taxes, related transportation fees, governmental levies, excess baggage and other non-ticket costs. The value of AIR MILESĀ® reward miles redeemed for non-flight reward options depends on reward options in effect at the time of redemption. AIR MILES reward miles prize is subject to the terms and conditions of the AIR MILES Reward Program as amended from time to time. AIR MILES reward miles prize is not transferable or convertible to cash and must be accepted as awarded.

    Entry Prizes: There will be two hundred and fifty (250) Entry Prizes available (one (1) for each of the first 250 eligible entrants to enter the Contest in accordance with these Rules – see Rule 7), each consisting of one hundred (100) AIR MILES reward miles (the "Entry Prize(s)"). Approximate retail value of the Entry Prize varies by travel service and date selected - example: from Vancouver to Calgary return air travel for one passenger for October departure is 1,025 air miles, which is approximately $528.00 CDN.

    Entry Prizes, Finalist Prizes and the Grand Prize (collectively, "Prize(s)") must be accepted as awarded and are not transferable, assignable or convertible to cash. No substitutions except at Sponsor's option. Sponsor reserves the right, in its sole and absolute discretion, to substitute any Prize or a component thereof with a prize of equal or greater value, including, without limitation, but at Sponsor's sole and absolute discretion, a cash award. For greater certainty, one eligible entrant can win: (i) the Grand Prize; (ii) one (1) Finalist Prize; and (iii) one (1) Entry Prize.

    Prizes will be credited to each winner's Card (based on the Card number provided at the time of entry). Redemption of the reward miles will be subject to the terms and conditions of the AIR MILES Reward Program, including any requirement to pay applicable airport taxes. Bank of Montreal is not an agent of LoyaltyOne, Inc. ("LMG") and takes no responsibility regarding the redemption of AIR MILES reward miles or otherwise for the operation of the AIR MILES Reward Program.

  6. FINALIST PRIZE AND GRAND PRIZE WINNER SELECTION PROCESS:

    Round One (Judging; eight (8) Finalists):

    An initial panel of judges (the "Initial Contest Judges") appointed by the Sponsor will judge all eligible Entries on the basis of the following weighted criteria:

    *Note: The optional Photo (if submitted) will not be factored into the judging process.

    Each eligible Entry will be given a score (the "Score") by the Initial Contest Judges and judging will be completed on a weekly basis, as follows:

    NON-WINNING ELIGIBLE ENTRIES WILL AUTOMATICALLY CARRY FORWARD TO BE CONSIDERED IN SUBSEQUENT WEEKS. FOR GREATER CERTAINTY, THE SCORE FROM THE PREVIOUS WEEK WILL CARRY FORWARD TO BE CONSIDERED IN SUBSEQUENT WEEKS (I.E. THE ENTRY WILL NOT BE RE-JUDGED).

    Odds of being selected as an eligible Finalist (defined below) depend on the number and calibre of eligible Entries received during each Submission Period. For each Submission Period, the eligible entrants associated with the top two (2) Entries based on total Score (as determined by the Initial Contest Judges, in their sole and absolute discretion) will be selected as eligible Finalists (defined below) and will be eligible to move to the next phase (see below) for selection of the eligible Grand Prize winner (subject to compliance with these Rules). In the event of a tie between two or more Entries based on total Score, the eligible entrant associated with the eligible Entry – from amongst all such eligible Entries that are tied – with the highest score on Best Story that illustrates house hunting tips, advice and/or learnings will be deemed to be the eligible Finalist (defined below).

    Before being declared as a confirmed Finalist (the "Finalist(s)"), each selected Finalist must sign and return within two (2) business days of notification a declaration and release prepared by the Sponsor, which, among other things: (i) confirms compliance with these Rules; (ii) agrees to release the Releasees from any and all claims, damages, liabilities, costs, and expenses arising from any liability in connection with this Contest and/or his/her participation therein; (iii) assigns all intellectual property, including copyright, in and to his/her Entry (and each component thereof) and waives his/her moral rights therein in favour of the Sponsor; (iv) agrees to indemnify the Releasees against any and all claims, damages, liabilities, costs, and expenses arising from use of his/her Entry (or, a component thereof), including, without limitation, any claim that his/her Entry (or, a component thereof), infringes a proprietary interest of any third party; (v) agrees to the publication, reproduction and/or other use of his/her name, address, voice, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by the Sponsor in any manner whatsoever, including print, broadcast or the internet; (vi) acknowledges acceptance of the Finalist Prize as awarded; and (vii) agrees to release the Releasees from any and all claims, damages, liabilities, costs, and expenses arising from any liability in connection with the awarding and use/misuse of the Finalist Prize or any portion thereof. If a selected Finalist: (i) cannot be contacted within a maximum of three (3) attempts or within two (2) business days of the applicable Finalist Announcement Date (whichever occurs first), or if there is a return of any notification as undeliverable; (ii) fails to return the properly executed Contest documents within the specified time; and/or (iii) cannot be a Finalist for any reason; then he/she will forfeit their opportunity to be a Finalist and the Sponsor reserves the right, in its sole and absolute discretion, to select the eligible entrant who received the next highest Score in accordance with these Rules to be an eligible Finalist (in which case the foregoing provisions of this section shall apply to such new eligible Finalist). Each confirmed Finalist will receive one (1) Finalist Prize (subject to compliance with these Rules).

    Round Two (Judging; 1 Grand Prize Winner):

    A new panel of judges (the "Finalist Contest Judges") appointed by the Sponsor will judge all Finalist Entries on the basis of the following weighted criteria:

    *Note: The optional Photo (if submitted) will not be factored into the judging process.

    **Prior to being posted on the BMO SmartSteps® for Homeowners Blog, the Reviewer reserves the right, in its sole and absolute discretion, to edit or modify any Finalist's Entry (or, a component thereof), or to request an entrant to modify his or her Entry (or, a component thereof) for any reason.

    Each Finalist Entry will be given a Finalist score (the "Finalist Score") by the Finalist Contest Judges. For greater certainty, the Score from Round One (see above) does not carry forward to Round Two and will be reset to zero. Odds of being selected as the eligible Grand Prize winner depend on: (i) the calibre of each Finalist's Entry; and (ii) on the comments and feedback (if any) on the Story (as posted on the BMO SmartSteps® for Homeowners Blog). The Finalist associated with the top Finalist Entry based on total Finalist Score (as determined by the Finalist Contest Judges, in their sole and absolute discretion) will be selected as the eligible Grand Prize winner. In the event of a tie between two or more Finalist Entries based on total Finalist Score, the Finalist associated with the Finalist Entry – from amongst all such Finalist Entries that are tied – with the highest score on Best Story that illustrates house hunting tips, advice and/or learnings will be deemed to be the eligible Grand Prize winner. Judging is scheduled to be completed on or about October 20, 2011 (the "Grand Prize Selection Date").

    The Sponsor, or its designated representative(s), will make a maximum of three (3) attempts to contact the eligible Grand Prize winner by email (using the information provided at the time of entry) within one (1) business days following the Grand Prize Selection Date. If the eligible Grand Prize winner cannot be contacted within three (3) attempts or two (2) business days as outlined above (whichever occurs first), or if there is a return of any notification as undeliverable; then he/she will be disqualified (and will forfeit all rights to the Grand Prize) and the Sponsor reserves the right, in its sole and absolute discretion, to select an alternate Finalist based on the next highest Finalist Score in accordance with these Rules to be the eligible Grand Prize winner (in which case the foregoing provisions of this section shall apply to such new eligible Grand Prize winner).

    BEFORE BEING DECLARED THE CONFIRMED GRAND PRIZE WINNER, the eligible Grand Prize winner must sign and return within two (2) business days of notification a declaration and release prepared by the Sponsor, which, among other things: (i) confirms compliance with these Rules; (ii) acknowledges acceptance of the Grand Prize as awarded; and (iv) agrees to release the Releasees from any and all claims, damages, liabilities, costs, and expenses arising from any liability in connection with this Contest, his/her participation therein and/or the awarding and use/misuse of the Grand Prize or any portion thereof. If the eligible Grand Prize winner: (a) fails to return the properly executed Contest documents within the specified time; and/or (b) cannot accept the Grand Prize for any reason; then he/she will be disqualified (and will forfeit all rights to the Grand Prize) and the Sponsor reserves the right, in its sole and absolute discretion, to select an alternate Finalist based on the next highest Finalist Score in accordance with these Rules to be the eligible Grand Prize winner (in which case the foregoing provisions of this section shall apply to such new eligible Grand Prize winner).

  7. ENTRY PRIZE SELECTION PROCESS:

    The first two-hundred and fifty (250) entrants eligible to enter the Contest in accordance with these Rules will each be eligible to win one (1) Entry Prize. Odds depend on the number and timing of eligible Entries received. BEFORE BEING DECLARED A CONFIRMED ENTRY PRIZE WINNER, each eligible entrant will be required to correctly answer a time-limited, mathematical skill-testing question without mechanical or other aid. By participating in the Contest and accepting an Entry Prize, each eligible entrant hereby: (i) confirms compliance with these Rules; (ii) acknowledges acceptance of the Entry Prize as awarded; (iii) releases the Releasees from any and all liability in connection with this Contest, his/her participation therein and/or the awarding and use/misuse of the Entry Prize or any portion thereof; and (iv) agrees to the publication, reproduction and/or other use of his/her name, address, voice, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor in any manner whatsoever, including print, broadcast or the internet. A declaration and release may also be required to be signed by any travelling companion(s) of any Entry Prize winner. If an eligible entrant: (a) fails to correctly answer the skill-testing question; (b) fails to return the properly executed Contest documents within the specified time; and/or (c) cannot accept the Entry Prize for any reason; then he/she will forfeit all rights to the Entry Prize and the Sponsor reserves the right, in its sole and absolute discretion, to award the Entry Prize the next eligible entrant to enter the Contest in accordance with these Rules (in which case the foregoing provisions of this section shall apply to such new eligible entrant).

  8. GENERAL CONDITIONS:

    All Entry materials become the property of the Sponsor and none will be returned. This Contest is subject to all applicable federal, provincial and municipal laws and regulations. The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of Entries and/or entrants.

    The Releasees will not be liable for: (i) any failure of any website during the Contest Period; (ii) any technical malfunction or other problems relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; (iii) the failure of any Entry to be received by the Contest Parties for any reason, including, but not limited to, technical problems or traffic congestion on the Internet or at any website; (iv) any injury or damage to an entrant's or any other person's computer or other device related to or resulting from participating or downloading any material in the Contest; and/or (v) any combination of the above.

    In the event of a dispute regarding who submitted an Entry, Entries will be deemed to have been submitted by the authorized account holder of the email address submitted at the time of entry. "Authorized account holder" is defined as the person who is assigned an email address by an internet provider, online service provider, or other organization (e.g. business, educational institute, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. An entrant may be required to provide proof (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification) that he/she is the authorized account holder of the email address associated with the selected Entry, and, if applicable, that he/she has all necessary consents, permissions and/or licenses as required by these Rules.

    The Sponsor reserves the right, in its sole and absolute discretion, to withdraw, amend or suspend this Contest (or to amend these Rules) in any way, in the event of an error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the reasonable control of the Sponsor that corrupts the security or interferes with the proper conduct of this Contest as contemplated by these Rules. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest in any way (as determined by Sponsor in its sole and absolute discretion) is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. The Sponsor, in its sole and absolute discretion, reserves the right to cancel, amend or suspend this Contest, or to amend these Rules, without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason.

    By entering this Contest, each entrant expressly consents to the Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted with his/her Entry only for the purpose of administering the Contest and in accordance with Sponsor's privacy policy (available at: http://www.bmo.com/home/about/banking/privacy-security/our-privacy-code or at any Bank of Montreal branch), unless the entrant otherwise agrees. The Sponsor may retain and use the contact information contained in the Entry materials for future marketing of its products and services to the entrant and may share it within the BMO Financial Group (that is, the Sponsor and its subsidiaries and affiliates) which provide deposit, loan, investment, securities, brokerage, insurance, trust and other products and services. If the entrant does not want his/her information retained, shared or to be used for these purposes, please contact the Sponsor at Corporate Marketing, 55 Bloor Street West, 5th Floor, Toronto, ON, M4W 3N5 or visit your nearest Bank of Montreal Branch.

    The Sponsor reserves the right, in its sole and absolute discretion, and without prior notice, to adjust any of the dates and/or timeframes stipulated in these Rules, to the extent necessary, for purposes of verifying compliance by any entrant or Entry with these Rules, or as a result of technical problems, or in light of any other circumstances which, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Rules.

    In the event of any discrepancy or inconsistency between the terms and conditions of these Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to, point of sale, television, print or online advertising; the terms and conditions of these Rules shall prevail, govern and control.

  9. REGARDING LOYALTYONE:

    The contest is managed by Bank of Montreal. LoyaltyOne, Inc. ("LoyaltyOne") is in no way connected to the management of this contest.
