BMO SmartSteps for Students “Submit A Tip” Contest (the “Contest”)
Official Rules & Regulations
HOW TO ENTER:
No purchase necessary. The Contest begins on September 1, 2010 and ends on April 30, 2011 at 11:59 am ET (“Contest Period”). To enter the Contest, submit a Student Tip to bmo.com/student following the Tip Submission Requirements below.
To be eligible, entries must be received during the Contest Period.
Entries will be rejected if the Tip (as defined below) does not conform to the Tip Submission Requirements. BMO Bank of Montreal (“the Sponsor”), and its advertising and promotional agencies are not responsible for late, lost, misdirected, delayed, incomplete or incompatible entries.
TIP SUBMISSION REQUIREMENTS:
The topic of your tip submission (each such submission (a “Tip”) must:
- Be regarding money management (eg. budgeting, saving, smart spending, etc)
- Be relevant to Canadian post-secondary students;
- Not be a Tip already used in past BMO SmartSteps for Students newsletters;
To be eligible for entry in the Contest, your Tip must meet the following requirements:
- Length: Maximum of 500 characters
- Language: English or French
- Format: Provided via submission form at bmo.com/student
Additionally, by participating in the Contest, each entrant agrees to be bound by these official rules and regulations (the “Rules”) and by the interpretation of these Rules by the Sponsor, and further warrants and represents that the Tip:
- is original to him or her;
- does not and will not violate any law, statute, ordinance or regulation;
- does not contain any reference to third parties unless consent has been obtained in writing from all such individuals;
- will not give rise to any claims of infringement, invasion of privacy or publicity, or infringe on any rights and/or interests of any third party, or give rise to any claims for payment whatsoever; and
- is not and will not be defamatory, trade libelous, pornographic or obscene, and further that it will not contain, include, discuss or involve, without limitation, any of the following:
- Obscenities;
- Nudity;
- Explicit, graphic or excessive sexual activity;
- Crude, vulgar or offensive language and/or symbols;
- Derogatory characterizations of any ethnic, racial, sexual or religious groups;
- Content that endorses, condones or discusses any illegal or inappropriate activity, behaviour or conduct;
- Personal information of individuals, including without limitation, names, addresses (physical or e-mail), phone and/or fax numbers;
- Conduct or other activities in violation of these rules;
- Commercial messages, comparisons or solicitations for products or services (other than those of the Sponsor)
- URLs or links to any websites; and
- Any other content that is or could be considered inappropriate, unsuitable or offensive, as determined by the Sponsor in their sole discretion.
- By entering the Contest and submitting a Tip, each entrant (and his or her parent/legal guardian if he or she is under the age of majority in his or her jurisdiction of residence): (i) grants to the Sponsor, in perpetuity, non-exclusive license to publish, display, reproduce, modify, edit or otherwise use the Tip in whole or in part on any website operated by the Sponsor (the “Website”) and/or for advertising or promoting the Contest or for any other reason without compensation; and (ii) agrees to release and hold harmless the Sponsor and its advertising and promotion agencies, the contest judges and each of their respective agents, employees, directors, successors, and assigns against any and all claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trade-mark infringement or any other intellectual property related cause of action. For greater certainty, the Sponsor and/or the Contest judges reserve the right, in their sole discretion, to modify, edit or remove any Tip, or to request an entrant to modify or edit his or her Tip, if a complaint is received with respect to the Tip, or for any other reason.
The Sponsor reserve the right to disqualify from the Contest any Tip that they deem, in their sole discretion, to violate the terms and conditions set forth in these Rules.
ELIGIBILITY:
To enter and be eligible to win, a person must be a resident of Canada, have reached the age of majority in the province in which they reside or obtained permission from a parent/legal guardian if under the age of majority, and not be an employee of, or a member of the immediate family of or domiciled with an employee of, the Sponsor or its affiliated companies, agents, advertising or promotional agencies, or contest prize suppliers, or the independent contest organization. Further, the person must:
- Be enrolled in a Canadian post-secondary institution; and
- Provide a valid email address.
PRIZES:
There will be a maximum of sixteen (16) prizes, two for each of the months of September 2010 to April 2011, inclusive, each consisting of a $50 Tim Hortons gift card (each a “Prize” and more than one “Prizes”). The Prizes must be accepted as awarded, and no substitutions for, or transfer of Prizes will be allowed. The Prize cannot be exchanged for cash. Sponsor reserves the right to substitute a Prize of equal or greater value in Sponsor’s sole discretion. Maximum one Prize per person. Each Prize must be claimed by the winner within 30 days from being declared a winner. Prizes will be awarded by the 30th of each month for inclusion in the following months’ newsletter, in accordance with the winner selection process described below.
WINNER SELECTION PROCESS:
On the 15th of each month, or first business day after the 15th, if the 15th falls on a weekend or holiday (the “Review Day”), all Tips submitted since the last Review Day will be compiled and reviewed by the Sponsor. A maximum of 2 Tips will be chosen by the 20th day of each month, or the first business day after the 20th, if the 20th falls on a weekend or holiday, to be included in the upcoming BMO SmartSteps for Students newsletter. Choice of Tips for inclusion are at the sole discretion of the Sponsor, and all decisions are final. In the event that no Tips are chosen, there will be no Prizes awarded for that month.
GENERAL CONDITIONS:
By entering the Contest, all entrants agree as follows: (i) that the Sponsor shall have right to publish, display, reproduce, modify, edit or otherwise use their Tips in whole or in part on the Website and/or for advertising or promoting the Contest or for any other reason; (ii) to the use of their name, address, voice, statements about the Contest and/or photograph or other likeness without further compensation, in any publicity or advertisement carried out by the Sponsor in any manner whatsoever, including print, broadcast or the Internet; and (iii) to release and hold harmless the Sponsor and its advertising and promotion agencies, employees, directors, successors, and assigns, against any and all claims, injury or damage arising out of or in relating to participation in the Contest, and further against any claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trade-mark infringement or any other intellectual property related cause of action.
Without limitation, each of the Sponsor, its advertising and promotion agencies (collectively the “Indemnified Parties”) will not be liable for any of the following: any failure of the website or the related email submission address during the Contest; for any technical malfunction or other problems relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; for the failure of any Tip to be received by the Sponsor or its advertising and promotion agencies for any reason including, but not limited to, technical problems or traffic congestion on the Internet or at any web site. Further, each of the Indemnified Parties will not be liable for any injury or damage to an entrant’s or any other person’s computer related to or resulting from participating or downloading any material in the Contest.
The Sponsor reserves the right, to withdraw or amend this Contest in any way, in the event of an error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of the Contest as contemplated by these Rules. In the event the Contest is withdrawn in accordance with these Rules, there will be a random draw conducted amongst all eligible Prize claimants to award the Prizes after the contest closing date.
Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law.
The Sponsor reserves the right, with the consent of the Régie des alcools, des courses et des jeux (the “Régie”) in the province of Québec, to terminate or amend this Contest at any time and in any way, without prior notice. Without limiting the foregoing, if, for any reason, the Contest is not capable of running as originally planned, the Sponsor reserves the right with the consent of the Régie to cancel the Contest. The Sponsor shall not be held responsible for any problems, errors or negligence that may arise or occur in connection with the Contest.
For Québec residents only: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling; any litigation respecting the awarding of a Prize may be submitted to the Régie des alcools, des courses et des jeux only for the purpose of helping the parties reach a settlement.
This Contest is subject to all applicable federal, provincial and municipal laws. Void where prohibited by law. The decisions of the Sponsor with respect to all aspects of this contest are final and binding on all entrants without right of appeal.
By submitting an Entry, the entrant represents and agrees that all Tips comply with all conditions stated in these Rules. The Sponsor and those associated with them will bear no legal liability, expressed or implied, regarding the use of the Tip by the Sponsor and THE SPONSOR SHALL BE HELD HARMLESS BY AN ENTRANT IN THE EVENT IT IS SUBSEQUENTLY DISCOVERED THAT THE ENTRANT HAS DEPARTED FROM OR NOT FULLY COMPLIED WITH ANY OF THE RULES.
The Sponsor reserves the right to cancel or suspend this Contest in the event of any accident, printing, administrative, or other error of any kind without prior notice or obligation.
By entering this Contest, each entrant expressly consents to the Sponsor, its agents and its representatives, storing, sharing and using the personal information submitted with his or her entry only for the purpose of administering the Contest and publicizing the Contest and in accordance with the Sponsor’s Privacy Policy (available at: bmo.com/privacy), unless the entrant otherwise agrees.

POSTING PROCESS:
Although all effort will be made to post comments and questions as soon as possible, posting of comments can take up to 2 business days, while posting/answering of questions can take up to 30 business days. BMO Bank of Montreal (the “Sponsor”) reserves the right to not post a comment or question or delete any posted comment or question it deems inappropriate as per the submission requirements below, or for any other reason, in their sole discretion.
SUBMISSION REQUIREMENTS:
To submit a comment, question, or both (any comment or question submitted hereafter a “Submission”) to the BMO SmartSteps for Students website, the following requirements must be met:

The BMO Bank of Montreal® Battle Your Budget Contest (the “Contest”)
OFFICIAL RULES AND REGULATIONS
Open to residents of Canada
NO PURCHASE NECESSARY. SEE ELIGIBILITY SECTION BELOW FOR FURTHER DETAILS. TO COMPLETE YOUR ENTRY YOU MUST READ AND AGREE TO THE FOLLOWING CONTEST RULES (THE “CONTEST RULES”). PARTICIPATION IN THIS CONTEST CONSTITUTES FULL AND UNCONDITIONAL AGREEMENT AND ACCEPTANCE OF THESE CONTEST RULES.
- NO PURCHASE NECESSARY. The BMO Bank of Montreal® Battle Your Budget Contest (the “Contest”) is sponsored by Bank of Montreal (the “Sponsor”). The Contest begins at 12:00:01 a.m. Eastern Time (“ET”) on August 30, 2010 and ends at 11:59:59 p.m. ET on November 30, 2010 (the “Contest Period”).
- ELIGIBILITY: To be eligible to win, a person must be a legal resident of Canada who has reached the age of majority in the Province in which they reside, is enrolled in a 2010-2011 full-time program at a Canadian University or Canadian College within Canada at the start of the Contest (being August 30, 2010) and who is not an employee, agent or representative of the Sponsor, its affiliated companies or agents, its respective advertising or promotional agencies, the independent contest organization or a member of any such employee’s immediate family (regardless of where they live) or persons with whom they are domiciled (whether related to the employee or not). In these Contest Rules, “immediate family” includes mother, father, brothers, sisters, sons, daughters, partner and/or spouse. Each entrant under the age of majority must have a parent or legal guardian’s permission to enter the Contest and if selected for a Prize, to act on his or her behalf in regard to completing the Release Form and accepting a Prize (see rule 8).
- HOW TO ENTER THE CONTEST: There are two (2) ways to enter the Contest:
- uring the Contest Period, visit www.bmo.com/student (the "Contest Website") and sign up to receive the BMO SmartSteps for Students e-Newsletter. Complete the entry form (the “Entry Form”) with your full name, valid email address and the name and province of the college or university you are attending. Next, indicate whether you would like to receive information regarding upcoming promotions from the Sponsor (this step is not mandatory). By doing so, you will automatically be entered into the Contest.
OR - During the Contest Period, visit the BMO kiosk located at a participating Event Location (see rule 4) and talk to the BMO representative on how to sign up to receive the BMO SmartSteps for Students e-Newsletter. Using the terminal provided, complete the Entry Form with your full name, valid email address and the name and province of the college or university you are attending. Next, indicate whether you would like to receive information regarding upcoming promotions from the Sponsor (this step is not mandatory). By doing so, you will automatically be entered into the Contest.
Entries must be received on or before 11:59:59 p.m. ET on November 30, 2010 (the “Contest Closing Date”). Limit of one (1) entry per person regardless of method of entry. You may only use one (1) email address to enter the Contest.
- uring the Contest Period, visit www.bmo.com/student (the "Contest Website") and sign up to receive the BMO SmartSteps for Students e-Newsletter. Complete the entry form (the “Entry Form”) with your full name, valid email address and the name and province of the college or university you are attending. Next, indicate whether you would like to receive information regarding upcoming promotions from the Sponsor (this step is not mandatory). By doing so, you will automatically be entered into the Contest.
- EVENT LOCATIONS AND DATES. There are a total of fifteen (15) Events held at the following locations (herein referred to as an “Event Location”) during the Contest Period:

Event dates are subject to change. No responsibility is assumed by the Sponsor or the independent contest organization for cancelled, delayed, suspended or rescheduled events for any reason whatsoever. - PRIZES: There will be one hundred and fifteen (115) Prizes (each a “Prize”) available to be won.
- Grand Prize: There will be fifteen (15) grand Prizes available to be won, each consisting of $1,500.00 CDN.
- Secondary Prize: There will be one hundred (100) secondary Prizes available to be won, each consisting of $100.00 CDN.
Prizes must be accepted as awarded without substitution and are not transferable. Limit of one (1) Prize per person.
- DRAWING: A random draw will be held on December 10, 2010 at approximately 10:00 a.m. ET (the “Draw Date”) in Oakville, ON from among all eligible entries received by the Contest Closing Date. The first (1st) to fifteenth (15th) selected entrants will be eligible for a Grand Prize and the sixteenth (16th) to one hundred and fifteenth (115th) selected entrants will be eligible for a Secondary Prize. Odds of being selected depend on the total number of eligible entries received by the Contest Closing Date. Each selected entrant will be contacted by email within ten (10) business days of the Draw Date. If a selected entrant (a) cannot be reached by email within ten (10) business days of the Draw Date; (b) fails to correctly answer the skill testing question (see rule 8); or (c) fails to return the properly executed Release Form within the specified time (see rule 8), then he or she will be disqualified and another entrant will be randomly selected until such time as contact is made by email with a selected entrant or there are no more eligible entries, whichever comes first. The Sponsor will not be responsible for failed attempts to contact a selected entrant.
- GENERAL: By participating in the Contest, each selected entrant agrees to abide by these Contest Rules and the decisions of the independent contest organization, with respect to all aspects of the Contest, which decisions are final.
- To be declared a winner, each selected entrant must answer correctly, without assistance of any kind, whether mechanical or otherwise, a mathematical skill-testing question posed by email. Each selected entrant (or his or her parent or legal guardian if the selected entrant is under the age of majority) will also be required to sign a Declaration and Release Form (the “Release Form”) confirming compliance with the Contest Rules, acceptance of a Prize as awarded, without substitution, and releasing the Sponsor, its affiliated and related companies, advertising and promotional agencies, the independent contest organization and their respective shareholders, directors, officers, employees, agents, representatives, successors and assigns (collectively, the “Released Parties”) from any liability in connection with a Prize or the Contest. The Release Form must be returned within the time period specified on the Release Form or the Prize will be forfeited. Upon receipt of the completed Release Form, the Prize will be deposited by the Sponsor into the winner’s BMO Everyday Banking Account. If a winner does not have a BMO Everyday Banking Account., the Sponsor will award the Prize in the form of a cheque made payable to the winner as his or her name appears on the Entry Form.
- The Released Parties accept no responsibility for loss, damage or claims caused by or resulting from the Contest or a Prize. By participating and accepting a Prize, each winner consents to the use of his or her name, address (city and province or territory) and/or photograph without further remuneration, in connection with any publicity carried out by or on behalf of the Sponsor with respect to the Contest.
- The Released Parties will not be liable for any failure of the Contest Website and do not assume any responsibility for incorrect or inaccurate capture of entry information, technical malfunctions, human or technical error, printing errors, lost, delayed or garbled data or transmissions, omission, interruption, deletion, defect or failures of any telephone or computer lines or networks, computer equipment, software or any combination thereof. Entries are subject to verification by the independent contest organization. The Released Parties are not liable for (a) late, lost, delayed, not received, damaged, misdirected, incomplete, stolen, fraudulent or illegible entries (all of which entries shall be automatically void and not eligible for a Prize); (b) failure to receive entries due to transmission failures, busy signals, traffic congestion on the internet or at any website or technical failures of any kind, including, without limitation, malfunctioning of any network, servers, access providers, hardware or software, whether originating with sender or recipient, or (c) any injury or damage to entrant's or any other person's computer related to or resulting from participation or downloading any materials in this Contest and breaches of privacy due to interference by third party computer "hackers". Entry material or data not satisfying the entry requirements or that have been tampered with or altered are void. In the event it is determined that an entrant has entered the Contest in a fashion not sanctioned by these rules or has submitted more than the number of entries permitted by these rules, the entrant will be disqualified and all of the entries submitted by the entrant will be disqualified.
- The Sponsor reserves the right, with the consent of the Régie des alcools, des courses et des jeux (the “Régie”) in the province of Québec, to terminate or amend this Contest at any time and in any way, without prior notice. Without limiting the foregoing, if, for any reason, the Contest is not capable of running as originally planned, the Sponsor reserves the right with the consent of the Régie to cancel the Contest. The Sponsor and the independent contest organization shall not be held responsible for any problems, errors or negligence that may arise or occur in connection with the Contest.

- The Sponsor respects your right to privacy. Personal information collected from entrants will only be used by the Sponsor to administer the Contest and, only if consent is given at the time of entry, to provide the entrants with information regarding upcoming promotions as well as events from the Sponsor. If entrants provide consent when entering the Contest, entrants consent to the manner of collection, use and disclosure of personal information as set out in the Sponsor’s privacy policy, which is available at bmo.com/privacy

BMO’s The money diarie$ (“THE Contest”)
THIS CONTEST IS GOVERNED BY CANADIAN LAW.
- ELIGIBILITY:
The Contest is open to all registered undergraduate students of The University of Toronto (“U of T”), British Columbia Institute of Technology (“BCIT”), L'Université de Montréal (“UdM”), and The University of Guelph (“U of G”, and together with U of T, BICT, and UdM, collectively the “Campuses” and each, a “Campus”), who are legal residents of Canada and have reached the age of majority in their province of residence, but are no older than 25 years of age, at the time of entry. Employees, representatives or agents (and those with whom such persons are domiciled, whether related or not) of Bank of Montreal (the “Sponsor”), its parent companies, subsidiaries, affiliates, distributors, prize suppliers, advertising or promotion agencies and the Contest judges (collectively, the “Contest Parties”) are not eligible to participate.
This Contest is in no way sponsored, endorsed or administered by, or associated with, YouTube. YouTube is completely released of all liability from each entrant in this Contest. Any questions, comments or complaints regarding the Contest must be directed to the Sponsor and not YouTube.

The application period begins on August 16, 2010 at 12:00:01 a.m. Eastern Time (ET) and ends on August 23, 2010 at 11:59:59 p.m. ET for U of T (the “U of T Application Period”), September 20, 2010 at 11:59:59 p.m. PT for BCIT (the “BCIT Application Period”), and October 4, 2010 at 11:59:59 p.m. ET for UdM and U of G (the “UdM Application Period” and “U of G Application Period”). - HOW TO APPLY:
Current customers of the Sponsor or those willing to open a bank account with the sponsor can apply by submitting a fully completed application form at www.bmo.com/students (the “Website”), which requires you to: (i) enter your first name, last name, complete mailing address, valid email address, telephone number and date-of-birth; (ii) answer a short questionnaire (the “Questionnaire”); and (iii) accept the terms and condition of these Official Rules and Regulations (the “Rules”).
There is a limit of one (1) entry per person permitted during the application period and you can only use one (1) email address to enter the Contest. If it is discovered that you attempted to enter more than one (1) time during the Application Period or use more than one (1) email address to enter the Contest; then (in the sole discretion of the Sponsor) you may be disqualified from the Contest and all of your entries voided. Your entry will be rejected if the application form (including the Questionnaire) is not fully completed and submitted during the Application Period. Use of any automated system to enter or otherwise participate in this Contest is prohibited and will automatically result in disqualification. The Contest Parties are not responsible for late, lost, misdirected, delayed, incomplete or incompatible entries. The Sponsor may disqualify an entrant for any reason, in its sole discretion. - ENTRY REQUIREMENTS:
By submitting An ENTRY, you agree that the ENTRY (AND ALL COMPONENTS THEREOF) complies with all conditions stated in these Rules. The releasees (defined below) will bear no legal liability, expressed or implied, regarding the use of your ENTRY (OR ANY COMPONENT THEREOF) by the CONTEST PARTIES and THE releasees SHALL BE HELD HARMLESS BY you IN THE EVENT IT IS SUBSEQUENTLY DISCOVERED THAT you have DEPARTED FROM OR NOT FULLY COMPLIED WITH ANY OF THE RULES.- is original to him/her and that the entrant has all necessary rights in and to the entry to enter the Contest;
- does not violate any law, statute, ordinance or regulation;
- does not contain any reference to or likeness of any identifiable third parties, unless written consent has been obtained from all such individuals and their parent/legal guardian if they are under the age of majority in their jurisdiction of residence;
- will not give rise to any claims of infringement, invasion of privacy or publicity, or infringe on any rights and/or interests of any third party, or give rise to any claims for payment whatsoever; and
- is not defamatory, trade libelous, pornographic or obscene, and further that it will not contain, depict, include, discuss or involve, without limitation, any of the following:
- Nudity;
- Explicit, graphic or excessive sexual activity;
- Crude, vulgar or offensive language and/or symbols;
- Derogatory characterizations of any ethnic, racial, sexual or religious groups;
- Content that endorses, condones and/or discusses any illegal, inappropriate or risky activity, behaviour or conduct;
- Personal information of individuals, including, without limitation, names and addresses (physical or electronic);
- Conduct or other activities in violation of these Rules;
- Commercial messages, comparisons or solicitations for products or services other than those of Sponsor;
- Any identifiable third party products and/or trade-marks, brands or logos, other than those of the Sponsor. For example, any clothing worn by persons and/or products appearing in your videos must not contain any visible logos, trade-marks or other third party materials; and
- Any other content that is or could be considered inappropriate, unsuitable or offensive, all as determined by the Sponsor and/or the Contest Parties in its/their sole discretion.
By participating in the Contest, each entrant agrees to be bound by these Rules and by the interpretation of these Rules by the Sponsor, and further warrants and represents that his or her entry:
The Sponsor and/or the Contest Parties reserve the right, in its/their sole discretion, to request an entrant to modify or edit his or her entry in order to ensure that the entry complies with these Rules, or for any other reason. Failure to comply with such request in a timely manner may result (in the sole discretion of the Sponsor and/or the Contest Parties) in your immediate disqualification from the Contest.
By entering the Contest and submitting an entry, each entrant: (i) grants to the Sponsor, in perpetuity, a non-exclusive license to publish, display, reproduce, modify, edit or otherwise use his or her entry (and all individual components thereof), in whole or in part, for advertising or promoting the Contest or for any other reason without compensation; (ii) waives all moral rights in and to his or her entry in favour of the Sponsor; and (iii) agrees to release and hold harmless the Contest Parties and each of their respective agents, employees, directors, successors, and assigns (collectively, the “Releasees”) from and against any and all claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trade-mark infringement or any other intellectual property related cause of action. - FINALIST SELECTION PROCESS:
A panel of judges appointed by the Sponsor will judge all eligible entries received from each Campus during the Application Period on the basis of: (i) answers to the Questionnaire; and (ii) the suitability of the entrant for The Money Diaries. Odds of your entry being selected depend on the number and calibre of eligible entries received from each Campus during the Application Period. The top entries, up to fifteen (15), from each Campus with the highest total score (the “Score”) will be deemed to be selected finalists (the “Finalist(s)”). Judging will be completed and the selected Finalists will be contacted by email or telephone on or about August 25, 2010 for U of T, September 22, 2010 for BCIT, and October 6, 2010 for UdM and U of G. If you have not been contacted by this date, you may assume that you are not a selected Finalist.
If any of the following apply, then the entrant will have forfeited their opportunity to be a Finalist and the Sponsor reserves the right, in its sole discretion, to deem the next eligible entrant (according to the next highest Score in the applicable Campus) to be a selected Finalist: (a) a selected Finalist cannot be contacted by phone or email within three (3) attempts or by August 26, 2010 for U of T, September 23, 2010 for BCIT, October 7, 2010 for UdM and U of G (whichever occurs first); or (b) there is a return of any notification as undeliverable. - MONEY DIARIES SELECTION PROCESS (5 PER CAMPUS):
Each of the Finalists from each Campus will be invited to participate in an interview process (the “Interview”) between August 25, 2010 and August 27, 2010 for U of T, September 22, 2010 and September 24, 2010 for BCIT, and October 6, 2010 and October 8, 2010 for UdM and U of G. The Interviews will be conducted by a designated representative of the Sponsor and will be scheduled at a pre-arranged mutually convenient time during the appropriate interview period. Finalists from will have their Interviews conducted either via telephone or in-person if feasible. If a Finalist is unable to attend or participate in the Interview at the specified time and location, then he/she will be disqualified. Each Finalist is solely responsible for any and all costs associated with participating in his or her Interview.
During the Interview, each Finalist will be asked a series of questions (the “Questions”) that have been provided or otherwise approved by the Sponsor. The Sponsor’s designated representative will judge each Finalist’s answers to the Questions on the basis of creativity of answers and suitability for The Money Diaries. All criteria will be weighed equally. The top five (5) Finalists in each Campus with the highest total score (the “Selection Score”) will be deemed to be selected for The Money Diaries (the “Participant(s)”). Odds of being chosen as a selected Participant in a Campus depend on the calibre of each Finalist’s answers to the Questions in that Campus. In the event of a tie based on total score, the Finalist (from among all such Finalists that are tied) with the highest Selection Score on the judging criteria will be deemed to be the selected Participant. Interviews and judging will be completed and the selected participants will be contacted by email or telephone by August 27, 2010 for U of T, September 27, 2010 for BCIT, and October 11, 2010 for UdM and U of G. If you have not been contacted by this date, you may assume that you are not a selected Participant.
Before being declared a PARTICIPANT, each selected Participant must sign an agreement (“The Money Diaries Agreement”) prepared by the Sponsor, which (among other things) states that:- Sponsor shall have the right, in perpetuity, to publish, reproduce and/or other use of the selected Participant’s name, address, voice, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by the Sponsor in any manner whatsoever, including print, broadcast or the internet without compensation;
- Selected Participant acknowledges acceptance of the Participant Prize (see below) as awarded and releases the Releasees from any and all liability in connection with this Contest, the selected Participant’s participation therein and/or the awarding and use/misuse of the Prize or any portion thereof;
- Selected Participant will be required (and agrees to take all steps necessary) to assign all intellectual property, including copyright, in and to any and all Content (defined in Rule 8) created by the participant during The Money Diaries and to waive his or her moral rights therein in favour of the Sponsor;
- Sponsor shall have the right, in its sole discretion, to modify, edit or remove any Content (defined in Rule 8), or to request the selected Participant to modify or edit his or her Content for any reason;
- Selected Participant must warrant and represent that he/she does not have a criminal record or pending criminal charges that may interfere with possible promotion events. In this regard, the selected Participant will be asked to sign a form permitting a "criminal" background check in a form acceptable to the Sponsor and in some jurisdictions may be required to personally attend at a police station and provide evidence of the criminal record search within the time limits set by Sponsor, failing which he/she will be disqualified from being a Participant; and
- No activity or commitment in the Participant’s agreement, including, without limitation, any publicity related requirements or commitments, will result in the selected Participant being deemed to be an employee of the Sponsor, nor will the Sponsor in any way be responsible for providing any employee type benefits to any selected Participant.
If any of the following apply, then the entrant will be forfeited (and will forfeit any right to his or her Participant Prize) and the Sponsor reserves the right, in its sole discretion, to deem the next eligible Finalist (according to the next highest Score in the applicable Campus) to be a selected Participant: (i) a selected Participant: (a) cannot be contacted by phone or email within three (3) attempts or by August 27, 2010 for U of T, September 28, 2010 for BCIT, and October 12, 2010 for UdM and U of G (whichever occurs first); or (b) fails to return the properly executed Participant’s Agreement within the specified time; and/or (ii) there is a return of any notification as undeliverable.
- PARTICIPANT PRIZES AND APPROXIMATE RETAIL VALUES:
Each Participant will receive one (1) new Flip Video Camcorder, with an approximate retail prize value of $259.99 upon being declared a Participant, and $1,000, payable by cheque to each Participant upon completion of three (3) webisodes and three (3) video diaries (collectively, the “Participant Prizes”). The Participant Prizes must be accepted as awarded and is not transferable or convertible to cash. No substitutions are permitted except at the Sponsor’s option. The Sponsor reserves the right, in its sole discretion, to substitute the Participant Prizes with a prize of equal or greater value, including, without limitation, a cash award.
If any Participant fails to return the properly executed Contest documents within the specified time; then he or she will forfeit their Participant Prize. - PARTICIPATION IN THE MONEY DIARIES:
On or about August 27, 2010 for U of T, September 27, 2010 for BCIT, and October 11, 2010 for UdM and U of G, the Sponsor and/or its designated representative will deem a group of five Participants to participate in The Money Diaries. In each Campus, Participants will be assigned to attend three (3) webisode shoots on their respective campuses, and record three (3) video diaries with their Flip Cam individually.
For each individual video diary, each Participant must use his or her Participant Prize to create online content (the “Content”) in the form of video. Further details about the video diaries and Content will be made available by the Sponsor’s designated representative. All Content must comply with the requirements outlined above in Rule 4. Within five (5) business days of the respective video diaries details being made available, the Participant will be required to visit a website and follow the on-screen instructions to upload the Content.
The Sponsor and/or the Contest Parties will screen all Content prior to it being publically available on the Website. Any Content that the Sponsor and/or the Contest Parties deem, in its/their sole discretion, to violate the terms and conditions set forth in these Rules will not be posted. Prior to being posted on the Website, the Sponsor and/or the Contest Parties reserve the right, in its/their sole discretion, to edit or modify any Content, or to request a Participant to modify or edit Content, in order to ensure that the Content complies with these Rules, or for any other reason. Any Content that is deemed appropriate will be posted on the Website. - GENERAL CONDITIONS:
By entering the Contest, each entrant agrees to the use of his or her entry, along with his or her name, address, voice, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by the Sponsor in any manner whatsoever, including print, broadcast or the Internet.
The Releasees will not be liable for any of the following: any failure of the Website or email during the Contest; for any technical malfunction or other problems relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; for the failure of any entry to be received by the Contest Parties for any reason including, but not limited to, technical problems or traffic congestion on the Internet or at any website; or any combination of the above. Further, the Releasees will not be liable for any injury or damage to an entrant’s or any other person’s computer related to or resulting from participating or downloading any material in the Contest.
In the event of a dispute regarding who submitted an entry, entries will be deemed to have been submitted by the authorized account holder of the email address submitted at the time of entry. The term “authorized account holder” is defined as the person who is assigned an email address by an internet provider, online service provider, or other organization (e.g. business, educational institute, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. An entrant may be required to provide proof that he/she is the authorized account holder of the email address associated with the selected entry and that he/she has all necessary consents, permissions and/or licenses as required by these Rules. The sole determinant of the time for the purposes of a valid entry in this Contest will be the Contest server machine(s). All entry are subject to verification. The Sponsor reserves the right, in its sole discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor) to participate in this Contest. Failure to provide such proof in a timely manner may result in disqualification.
The Sponsor reserves the right, subject to the approval of the Régie des alcools, des courses et des jeux (the “Régie”), to cancel, withdraw or amend this Contest in any way, in the event of an error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Contest as contemplated by these Rules. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law. The Sponsor, with the consent of the Régie, reserves the right to cancel or suspend this Contest, or to amend these Rules without prior notice or obligation, in the event of any accident, printing, administrative, or other error or any kind, or for any other reason.
This Contest is subject to all applicable federal, provincial and municipal laws. The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of entrants and/or entries.
By entering this Contest, entrants HEreby release and hold harmless the Sponsor from any liability in connection with this Contest or participation in any Contest related activities or, if declared a winner, any prizes, and any travel related thereto. This Contest will run in accordance with these Rules. Contest Sponsor reserves the right, subject to approval from the Régie des alcools, des courses et des jeux in Quebec, to cancel, amend, modify or terminate this Contest or the Rules at any time in its sole discretion and without further notice. Entrants must comply with the Rules, and will be deemed to have received and understood these Rules if he/she participates in the Contest.
For Quebec residents: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
By entering this Contest, each entrant expressly consents to the Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted with his or her entry only for the purpose of administering the Contest and in accordance with Sponsor’s Privacy Policy (available at: www.bmo.com/privacy) unless the entrant otherwise agrees. - INTELLECTUAL PROPERTY
All intellectual property, including, without limitation, all trade-marks, trade names, logos, designs, promotional materials, web pages, source code, drawings, illustrations, slogans and representations are owned by the Sponsor and/or its affiliates. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited. - LANGUAGE DISCREPANCY
In the event of any discrepancy or inconsistency between the terms and conditions of these Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to: the Contest entry form, French version of these Rules, and/or point of sale, television, print or online advertising; the terms and conditions of these English Rules shall prevail, govern and control.
