BMO Official Contest Rules

NO PURCHASE NECESSARY. SEE ELIGIBILITY SECTION BELOW FOR FURTHER DETAILS. BEFORE COMPLETING YOUR ENTRY YOU MUST READ AND AGREE TO THE FOLLOWING CONTEST RULES (THE "CONTEST RULES"). PARTICIPATION IN THIS CONTEST CONSTITUTES FULL AND UNCONDITIONAL AGREEMENT AND ACCEPTANCE OF THESE CONTEST RULES.

The BMO SPC MasterCard GRAMMY®†* Contest (the "Contest") is sponsored by Bank of Montreal ("BMO" or "Sponsor") and MasterCard Canada Inc. (together with BMO, the “Sponsors”). Contest begins at 12:00:01 a.m. (ET) on September 1, 2011 and ends at 11:59:59 p.m. (ET) on October 15, 2011 (the "Contest Period").

ELIGIBILITY: To enter and be eligible to win, you must be a legal resident of Canada who has reached the age of majority in your province or territory of residence at the time of entry and must not be an employee or spouse of an employee of the Sponsors, or their respective affiliated companies, agents, advertising or promotional agencies or the independent contest organization (collectively, the "Contest Parties").

HOW TO ENTER
: There are two (2) ways to enter:

Method No. 1
("Application Method") Apply by October 15, 2011 and be approved for a BMO SPC MasterCard, and use the card to make a purchase by November 30, 2011. Application must be for a BMO SPC MasterCard only. Each new BMO SPC MasterCard application will automatically be entered into the Contest. Limit of one entry per person.  To be eligible, the Sponsor must receive your completed application during the Contest Period.

Method No. 2 ("No Purchase Entry Method") Legibly hand print your full name, complete mailing address, valid email address (optional), day and evening telephone numbers, and age on a plain piece of paper and mail it, in a sealed envelope bearing sufficient postage to:  BMO SPC MasterCard GRAMMY Contest, PO Box 246, Dept-VIP GRAMMY Contest, Pickering, ON L1V 2R6. Limit of one (1) mail-in entry per person. Must have reached age of majority and be under 25 years of age at the time of entry.  The Sponsor will not accept mechanically reproduced, photocopied or bulk entries; all such entries will be void. Entries submitted by Method No. 2 must be postmarked during the Contest Period and be received no later than October 21, 2011.

Except as noted above for mail-in entries, all entries must be received by 11:59:59 PM (ET) on October 15, 2011 (the "Contest Closing Date"). "Contest Closing Date").

Grand Prize will only be awarded to the person whose contact information matches the contact information on the BMO SPC MasterCard application form. If the winning entry is in respect of a mail-in entry, then the Grand Prize will only be awarded to the person whose contact information matches the contact information set out in that mail-in entry.

GRAND PRIZE:
 There is one (1) Grand Prize to be won. Grand Prize consists of a VIP trip for the winner and one (1) guest to the 54th Annual GRAMMY Awards (“Awards”) on Sunday, February 12, 2012, consisting of round-trip (“R/T”) economy fare air travel for two (2) people between the Canadian international airport nearest to the winner’s residence and Los Angeles, California, via airline(s) to be selected by the Sponsor (winner and guest must depart from the same airport and travel on the same itinerary); four (4) consecutive nights double-occupancy accommodation at a hotel to be selected by the Sponsor (“Hotel”); $1,000.00 (CDN) credit towards the winner’s BMO SPC MasterCard. If the winner does not have a BMO MasterCard the Sponsor will award the $1,000.00 (CDN) portion of the Grand Prize in the form of a cheque; one (1) pair of tickets to see the Awards on Sunday, February 12, 2012, and one pair of tickets to the Awards After Party on Sunday, February 12, 2012; R/T transportation for two (2) between the Hotel and the Awards and R/T transportation for two (2) between the Hotel and the airport in Los Angeles; access for two (2) to a GRAMMYs rehearsal; a tour for two (2) of Los Angeles; access to walk the red carpet prior to the show; pre-event makeover by a stylist; and select meals. Approximate Retail Value (“ARV”) of the Grand Prize is $15,000.00 based on a Vancouver departure example. Actual value of Grand Prize vacation package depends upon point of departure, airfare, fluctuations of hotel rates, airfares and Canadian dollar exchange rate fluctuations. Winner is not entitled to any differences between stated and actual value. Winner and guest must be prepared to travel on or about Sunday, February 12, 2012 for the Awards, or this prize may be forfeited and an alternate Grand Prize winner may be selected. If any prize-related activity(s) is/are cancelled or postponed for any reason, travel prize will be awarded less applicable prize-related activity(s) and Sponsor will substitute that activity(s) with (an) item(s)/activity(s) of equal or greater value as determined solely by Sponsor.

All other expenses not specifically included above are the sole responsibility of the Grand Prize winner, including, but not limited to, the following costs: transportation for winner and his/her guest between the winner’s residence to and from the Canadian international airport closest to the winner’s place of residence, meals, taxes, fees, gratuities, health or other insurance and items of a personal nature.

Winner and guest must be legally able to travel to the United States and are solely responsible for obtaining documents necessary for international travel, including, but not limited to, passports. In the event that winner and/or his/her guest is/are refused entry into the United States or re-entry into Canada, Sponsors will not be responsible for any costs or expenses incurred to resolve the matter and/or return the winner and/or guest to the point of origin. Winner and guest must possess and show all necessary travel documents and other travel requirements prior to being declared an official winner. All travel arrangements must be made through the Sponsor or its agents. Flight times and schedules subject to change without notice. Additional travel restrictions may apply. 

The Sponsor and/or its representatives reserve the right at any time to substitute the prize, or any portion thereof, for a prize of comparable value. The prize has no cash value and must be accepted as awarded and is not transferable or assignable except at the Sponsor’s option.

WINNER SELECTION: The eligible winner will be selected in a random draw from all eligible entries received in accordance with these Contest Rules, on December 13, 2011, at approximately 3:00 pm (ET), in Whitby, Ontario. Odds of winning depend on the number of eligible entries received.

The selected winner will be contacted within three (3) days of December 13, 2011, by telephone at the telephone number provided by the entrant at the time of entry. At such time, the selected entrant will be required to correctly answer, unaided, a time-limited mathematical skill-testing question to be administered by the Sponsor and confirm his/her eligibility.

The winner and his or her Guest (or his/her parent/legal guardian if the Guest is a minor) will be required to sign the Sponsors' standard form of Declaration, Release and Waiver (the "Release") and return it within the time period specified on the Release. If the Guest does not return the Release within the time period specified therein, then the Guest will not be permitted to accompany the winner in claiming the Grand Prize.

If the selected winner does not meet all of the Contest conditions, fails to answer the skill-testing question correctly, does not sign and return the properly executed Release within five (5) days of being contacted by the Sponsor or contact cannot be made within five (5) days of Sponsors' first attempt at contact, that entry can, in the sole and absolute discretion of the Sponsor, be disqualified and Sponsor shall be entitled to select a new eligible winner from all remaining eligible entries. The Sponsor is not responsible, whether as a result of human error or otherwise, for any failure to contact any potential winner. Once declared the winner, the selected entrant will be directed as to how to claim his/her Grand Prize.

GENERAL:

  1. Entrants agree to be bound by the decisions of the Sponsor, which are final and binding without right of appeal with respect to all matters relating to the Contest.
  2. All application forms and entries will become the property of the Sponsor and will not be returned and proof of submission of a registration form or entry will not be proof of receipt.
  3. Entrants agree to hold harmless the Contest Parties and each of their respective officers, directors, agents, representatives, successors and assigns (collectively, the "Released Parties"), against any and all liability, damages or causes of action (however named or described) with respect to or arising out of: (i) registrant's or entrant's participation in the Contest, (ii) the receipt or use/misuse of the Grand Prize (or any component thereof) awarded therein; and (iii) the administration of the Contest and distribution of the Grand Prize.
  4. Before being awarded the Grand Prize, the potential winner, and his or her Guest (or his/her parent/legal guardian if the Guest is a minor), must sign the Release, releasing the Released Parties from any and all liability arising from, among other things: (i) participation in the Contest; and (ii) acceptance of the Grand Prize (or any component thereof) awarded therein; and (iii) the administration of the Contest and distribution of the prizes awarded therein. The Release will also grant to the Released Parties the right to the use of his or her name, address (city and province/territory), likeness and photograph without further notice or compensation in any publicity or for promotional purposes carried out by or on behalf of the Released Parties.
  5. The declared winner grants to the Sponsor the right to the use of his or her name, address (city and province/territory), likeness and photograph without further notice or compensation in any publicity or for promotional purposes carried out by or on behalf of the Sponsor.
  6. The Released Parties will not be responsible for late, lost, illegible, fraudulent, misdirected, incomplete, destroyed registration forms or entries or for entries bearing insufficient postage. All such registration forms and/or entries will be void.
  7. The Released Parties will not be responsible for any event that may cause the Contest to cease either temporarily or permanently, including, but not limited to, any website issue, electronic network, computer problem or any other technical or human error of any kind that makes continuation of the Contest not feasible. The Released Parties are not responsible for any technical malfunctions of telephone networks or lines, computer on-line systems, servers or access providers, computer equipment, software, viruses, bugs or failure of any entry to be received for any reason including but not limited to traffic congestion on the Internet. Further, the Released Parties will not be liable for any injury or damage to a registrant's or entrant's or any other person's computer related to or resulting from participating or downloading any material in the Contest.
  8. The Sponsor reserves the right, in their sole discretion, to disqualify any person and void any entries and/or registration forms of that person who it believes has tampered with the entry or registration process or any other component of the Contest, whose conduct or action affects the administration, security or fairness, integrity or proper conduct of the Contest, or who fails to meet or abide by these Contest Rules.
  9. No correspondence will be entered into except with the selected entrant. To receive a list of winners, send a postage-paid, self-addressed envelope, within 90 days of the Contest Closing Date to: Contest Administrator c/o PPFD Ltd. 80 William Smith Drive, Whitby ON L1N 9W1.
  10. This Contest is subject to all applicable federal, provincial and municipal laws.  Any litigation involving a Quebec resident respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling.  Any litigation involving a Quebec resident respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement. The Sponsor reserves the right subject to the approval of the Regie des alcools, des courses et des jeux to withdraw or amend this contest in any way, in the event of an error, tampering, unauthorized intervention, fraud or any other cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this contest as contemplated by these Rules. Any attempt to deliberately undermine the legitimate operation of this contest is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the full extent permitted by law, including criminal prosecution.  
  11. Proof of identity and/or eligibility (in a form acceptable to the Sponsor) to participate in this Contest. Failure to provide such proof in a timely manner may result in disqualification.
  12. By entering this Contest, each entrant expressly consents to the Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted with his/her entry only for the purpose of administering the Contest and in accordance with Sponsor’s Privacy Policy (available at bmo.com/privacy) unless the entrant otherwise agrees to receive further communication from Sponsor.
  13. In the event of any discrepancy or inconsistency between the terms and conditions of these Contest Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to: the Contest entry form, and/or point of sale, television, print or online advertising; the terms and conditions of these Contest Rules shall prevail, govern and control.
